近日,我司與加拿大LMI公司之間的專利訴訟迎來關(guān)鍵轉(zhuǎn)折。隨著國家知識產(chǎn)權(quán)局作出無效決定,宣告其主張我司侵權(quán)的權(quán)利要求無效,案件局勢已徹底明朗,LMI的侵權(quán)指控從根本上是無法成立的——技術(shù)的正當性與法律的公正性,終將站在真實創(chuàng)新者一邊。
事實澄清:涉案專利宣告無效,法律底牌彰顯公正
LMI公司據(jù)以提起訴訟的專利相關(guān)權(quán)利要求已被國家知識產(chǎn)權(quán)局宣告無效,這意味著一審判決所依據(jù)的權(quán)利基礎(chǔ)已不復(fù)存在,對方所謂“勝訴”在法律上徹底失去支撐。目前,我司已依法向最高人民法院申請駁回對方起訴,相關(guān)司法程序正在穩(wěn)步推進。

Hypersen Successfully Breaks Overseas Patent Barriers!

Recently, a pivotal turning point has been reached in the patent litigation between Hypersen and LMI Technologies Inc(Canada). With the China National Intellectual Property Administration (CNIPA) issuing a patent invalidation ruling that nullifies all infringement claims LMI asserted against Hypersen, the case has been fully clarified. LMI’s allegations of infringement are fundamentally untenable—technological legitimacy and judicial impartiality will always stand firmly on the side of genuine innovators.Facts Clarified: Litigated Patent Invalidated, Judicial Impartiality Upheld
All patent claims on which LMI initiated the lawsuit have been declared invalid by the China National Intellectual Property Administration (CNIPA). This renders the legal basis for the original first-instance judgment nonexistent, and LMI’s so-called "victory" has lost all legal support. At present, Hypersen has legally filed a motion to dismiss LMI’s lawsuit with the Supreme People’s Court of the People’s Republic of China, and the relevant judicial proceedings are progressing steadily.We reaffirm our commitment to a professional stance against any practice that uses litigation as a tool for commercial competition or attempts to disrupt market order. We will resolutely resort to legal means to safeguard our legitimate rights and interests and uphold industry fairness.
